Deciding whether or not to file suit

Our client had a substantial payment outstanding after a foreign customer had failed to pay for equipment purchased. Confident that judgement would be in its favour, the company wanted to sue to obtain payment and asked InfoForce to trace assets that could be seized at a later stage. Unfortunately, our research showed that the amount of assets that could be seized was far less than what was owed to our client.

In addition, InfoForce found that seven other plaintiffs had filed before our client and that under no circumstance could our client contemplate recovering a significant amount of what he was owed. Because of the legal costs involved in the foreign country, our client decided to take his loss and focus on developing new business.
